Luqmani Thompson & Partners win in European Court of Justice

06.06.2013 – Rakesh Singh, solicitor at Luqmani Thompson & Partners, has succeeded on behalf of a client before the European Court of Justice in Luxembourg.
Luqmani Thompson & Partners acted for a French national who was permanently resident in the UK but who was excluded from the country for national security reasons. He appealed against the decision. Our client was not made aware of the national security case against him and he therefore did not have an opportunity to raise an effective defence. This approach was upheld by the Special Immigration Appeals Commission in the UK. The case was referred to the Court of Justice of the European Union which decided that the state must disclose the full and precise grounds which are the basis of the national security case against an EU national or, if the state can prove that disclosure would be contrary to the interests of national security, it must disclose the essence of the grounds against the EU national.
